Website Terms of Use

Operator: Assertwise, Ireland ("Assertwise", "we"). Contact: via the contact form.

1. Scope

These terms apply to the use of this website and its free tools and AI chat ("Site"). Our offers are aimed at businesses. Paid services are provided only under a separate agreement (MSA/SOW). The privacy policy explains how we process personal data.

2. Free tools that send requests to third-party URLs

2.1 Some tools (API response time, security headers/CORS, SSL/TLS, rate-limit indicator, EAA Quick Scan) cause our server to send a small number of requests (currently at most 10 per check, User-Agent AssertwiseCheck/1.0) to a URL you enter. 2.2 Authorisation: you may only enter URLs of systems you own or are expressly authorised by the owner to test. By starting a check, you confirm this. 2.3 Prohibited: using the tools against systems without authorisation; trying to overload, disrupt or bypass the security of any system; scanning third parties at scale; automated or scripted use of the tools; circumventing rate limits; entering personal data, credentials or secrets; using results for unlawful purposes. 2.4 Rate limits: we limit use per IP address and per period (currently 10 checks per hour per IP address) and may change these limits, block requests, or suspend tools at any time. 2.5 Abuse: we may refuse service, keep the minimum data needed to deal with abuse and, where necessary, cooperate with affected parties or authorities. You indemnify us against third-party claims resulting from unauthorised checks you initiate, to the extent you are at fault. 2.6 Browser-only tools, including the DORA readiness self-assessment, run locally on your device.

3. AI chat and AI test-case generator

3.1 The Assertwise team answers the chat, sometimes through an AI assistant that is always labelled "Assertwise AI assistant" and is provided by an external AI service provider (details on request). Staff replies show a name or "Assertwise team". You can always ask for a person or leave a message (see section 6 of our privacy policy). The AI test-case generator is coming soon and not active yet. 3.2 Chat replies, especially those from the AI assistant, may be inaccurate, incomplete or outdated, and are not professional, legal, regulatory or security advice and not binding offers. Prices and scope are binding only in a signed agreement. 3.3 Do not enter passwords, secrets, confidential information, special categories of personal data or your customers' data. 3.4 You are responsible for checking any output before using it, including generated test cases.

4. No warranty for tool results

The tools and content are provided free of charge, "as is" and without guarantee of availability. Results are indicative point-in-time snapshots, not a security assessment, penetration test or compliance confirmation.

5. Liability

5.1 We are liable without limitation for intent and gross negligence, for injury to life, body or health, and where mandatory law (e.g. product liability) so provides. 5.2 For slight negligence, we are liable only for breach of an essential obligation and limited to the foreseeable, typical damage. Given that the tools are free, we are otherwise not liable for slight negligence. 5.3 These limitations apply as far as permitted under applicable Irish and German law, including §§ 305–310 BGB and § 521 BGB (by analogy for free services) where German law applies, and they also apply to our staff. 5.4 We are not responsible for third-party websites linked from the Site.

6. Intellectual property

Site content, code and tools are protected. You may use outputs you generate for your own purposes. No other rights are granted. Do not scrape or reproduce the Site at scale.

7. Changes and suspension

We may change or discontinue the Site, tools and these terms with future effect. The version in force when you use the Site applies.

8. Governing law and jurisdiction

Irish law applies, excluding the CISG. For businesses, the courts of Dublin, Ireland have exclusive jurisdiction. If a consumer uses the Site despite §1, mandatory protections of the law of their habitual residence and their right to sue there remain unaffected.

9. Severability

If a provision is invalid, the remainder stays effective.

In case of discrepancies, the English version prevails.
